Information from the abstract

Background Corruption in the procurement of goods/services in Indonesia is still high, so a new governance model based on the principles of prudence and sharia compliance is needed. Method This study aims to formulate and test a Sharia-based 6C model as a governance framework for public procurement of goods and services in Indonesia, in order to strengthen the principles of prudence and transparency. This study uses a normative legal approach with an interdisciplinary framework. The analysis is conducted through doctrinal studies, empirical data from the Corruption Eradication Commission (KPK) and the Indonesian Corruption Watch (ICW), and a socio-legal approach to assess the behavior of actors in tenders. The Fraud Triangle Theory is used to map the pressures, opportunities, and rationalizations of corruption. Furthermore, the 5Cs of banking are adapted and expanded into 6Cs by incorporating halal (lawful), fairness, and sustainability aspects. Results The findings reveal legal loopholes and institutional weaknesses in the public auction system, such as a lack of early detection mechanisms, limited access to information, and weak integration of halal regulations. The proposed 6C model, such as Character, Capacity, Capital, Collateral, Condition, and Halal Traceability, can strengthen transparency and accountability, as well as prevent collusion and tender manipulation. The Sharia-based 6C model offers a more comprehensive public procurement governance framework than the 5C principle. The integration of halal (halal), fairness, and environmental aspects makes the system more appropriate to the context of Muslim-majority Indonesia. Conclusion The implementation of this model is expected to be incorporated into presidential regulations to provide legal certainty, increase efficiency, and strengthen corruption prevention in state procurement.
